Terms of Service
The following Terms of Service (“TOS,” “Terms,” or “Agreement”) govern your access to and use of our website and all services, features, and content provided by HostraGo (“HostraGo,” “we,” “us,” or “our”).
By purchasing or using any service from HostraGo, you confirm that you have read, understood, and agree to be legally bound by these Terms. The most recent version of the TOS is always available on our website at www.hostrago.com.
We strongly recommend that you carefully review this Agreement before purchasing or using any of our services.
Customer Agreement
These Terms of Service apply to all services provided by HostraGo to you throughout the entire duration of your subscription, including any renewal terms. By signing up for any hosting plans or related services offered on HostraGo, you agree to be bound by all the terms and conditions set forth in this Agreement.
You also agree to use only properly licensed and legally obtained third-party software in connection with your use of our services.
HostraGo reserves the right to suspend, restrict, or terminate access to any or all of its services at any time if we determine, at our sole discretion, that your account has been misused or is in violation of these Terms.
1. Content
a) HostraGo reserves the right to deny service and/or restrict access to our servers to anyone, at our sole discretion. All services provided by HostraGo must be used for lawful purposes only. The transmission, storage, or presentation of any data, information, or material that violates any applicable law or regulation is strictly prohibited.
b) The following list includes examples of activities and content that are strictly forbidden on our servers. This list is not exhaustive and may be updated at any time:
c) Hosting or involvement in any of the following is prohibited: topsites, Ponzi or pyramid schemes, prime bank programs, bank debenture trading, cryptocurrency or bitcoin mining, forex platforms, e-gold schemes, proxies, bots, spam bots, mail bombers, port scanners, IP scanners, email harvesting scripts, brute force tools, chat rooms, banner rotators, file dumps, using server space for backup or secondary storage, sale of illegal pharmaceuticals, drugs, weapons or explosives, anonymous or bulk SMS gateways, malware, warez, phishing content, lottery or gambling services, illegal downloads, pirated software, escrow fraud, high-yield investment programs (HYIPs), adult banner exchanges or thumbnail galleries, and streaming or broadcasting of live copyrighted content.
d) HostraGo strictly prohibits any website content that promotes or advocates human trafficking in any form. This includes, but is not limited to, content related to prostitution, escort services, or any similar services. Determinations regarding violations of this policy will be made at HostraGo’s sole discretion.
e) Any website found to host or link to child pornography, exploitative content, or content that endangers minors will be suspended immediately without prior notice or warning. We have zero tolerance for such materials.
f) Adult Content – This includes all forms of pornography, erotic imagery, or other lewd, obscene, or sexually explicit content. What qualifies as “adult material” is determined solely at HostraGo’s discretion and may result in immediate suspension or termination.
g) Uploading or embedding high-resolution images, audio, or video content on your website, or linking to third-party websites that host such media, is strictly prohibited unless permitted by your specific hosting plan.
h) Illegal Material – You may not host or distribute any material that infringes on copyright or violates intellectual property laws. This includes, but is not limited to, unauthorized commercial audio, video, or music files, as well as deceptive or misleading content.
i) Warez Content – Hosting or linking to pirated software, ROMs, emulators, phreaking tools, hacking utilities, password cracking programs, IP spoofing techniques, or any similar materials is strictly prohibited. This also includes any website offering guides, tutorials, or resources on how to access or use such tools.
j) Games – Hosting any type of online game or gaming-related content (e.g., game servers, downloadable games, or game-related software) on HostraGo servers is not allowed. Violations of this policy may result in immediate termination of your hosting account.
k) IRC Hosting – Hosting an IRC (Internet Relay Chat) server or connecting to external IRC networks from your hosting account is strictly forbidden on HostraGo’s servers.
l) IRC Hosts – Hosting an IRC (Internet Relay Chat) server that is part of, or connected to, an external IRC network or server is strictly prohibited. This includes any form of communication or linking with IRC networks. Any server or virtual hosting account found to be connected to such networks will be immediately removed from our infrastructure without prior notice.Reconnection will only be considered once you agree to fully remove all traces of IRC-related software or activity, and grant HostraGo access to your server for verification. A second violation of this policy will result in permanent account termination without refund.
HostraGo also reserves the right to classify any content or material as “prohibited” at our sole discretion if it is deemed indecent, offensive, promotes hate, or is generally inappropriate for hosting on our network.

In accordance with the Digital Millennium Copyright Act (DMCA), HostraGo has established procedures for copyright holders who believe their rights are being infringed by content hosted on our services.
If you believe that a website hosted by HostraGo is using your copyrighted material without authorization, please send a formal complaint to our abuse department at [email protected]. All claims must include sufficient detail and supporting documentation in order to be reviewed and processed.
2. Abuse Of Resources
a) Unauthorized access attempts, or any actual breach of network devices owned by HostraGo or any third party (individual, organization, or service), are strictly prohibited. This includes activities such as port scanning, IP range scanning, and vulnerability scanning. All suspected or confirmed violations will be fully investigated and may result in immediate termination of services.
b) Denial of Service (DoS) attacks, whether directed at HostraGo or launched from within our network, are strictly forbidden. Any such attempt will lead to immediate suspension or termination of the account involved.
c) Hosting or distributing software, source code, or materials that are illegal or could facilitate illegal activities is strictly prohibited. This includes, but is not limited to: exploit tools, hacking scripts, malware (viruses, Trojans), bomb-making instructions, or any similar materials. All suspected misuse will be vigorously investigated and may result in permanent service suspension.
d) Hosting or sharing material that infringes on any copyright, trademark, or service mark is not allowed. This includes unauthorized storage or transmission of pirated movies, music, software, ringtones, or any other “warez”-type content. Verified copyright infringement claims may lead to service termination without notice.
e) Hosting any defamatory, private, or scandalous content about an individual or organization without consent, as well as content that intentionally causes emotional harm or violates intellectual property rights, is strictly prohibited.
f) Any attempt to undermine or interfere with the integrity of our servers or services will not be tolerated. HostraGo holds no responsibility for customer misuse of hosting accounts. If any account is found to be abusing server resources and the customer fails to take corrective action, the account may be immediately suspended or deactivated without refund.
g) Accounts that consume excessive CPU cycles or server resources, in a manner that negatively impacts the performance of other websites, may be subject to resource restrictions or required upgrades. While HostraGo offers a 99.99% uptime guarantee, brief downtime may occur during essential updates or maintenance tasks.
h) Disrespectful or abusive behavior toward any member of the HostraGo team will not be tolerated under any circumstances. We reserve the right to terminate services immediately and without refund in such cases.
3. Unsolicited commercial e-mail/Unsolicited bulk e-mail (SPAM)
a) Unsolicited Email (SPAM) – The use of HostraGo services to send unsolicited commercial or bulk email (commonly known as SPAM) is strictly prohibited. Any violation of this policy may result in severe penalties, including account suspension or termination without notice.
b) Upon receiving a report of a potential SPAM violation, HostraGo will conduct a thorough investigation. During this period, we may temporarily restrict the customer’s access to the network to prevent further potential abuse.
c) If a customer is found to be in violation of this policy, HostraGo reserves the right, at its sole discretion, to restrict, suspend, or permanently terminate the offending hosting account. We also reserve the right to pursue civil remedies to recover any costs incurred during our investigation. If the activity is deemed criminal in nature, HostraGo will report the matter to appropriate law enforcement authorities.
d) Accounts found to be supporting spammers or causing any HostraGo IP addresses to be listed on spam blacklists will be immediately suspended, and an administrative fee of $250 USD will be charged to the customer’s account.
e) The account will not be reinstated until all offending content is removed and the customer agrees to take all necessary steps to prevent further violations.
- First violations may result in a warning, and your account may be reviewed for termination.
- Second violations will lead to immediate account termination and an increased administrative fee of $500 USD.
- Severe or egregious violations may result in permanent removal from HostraGo’s network without prior notice.
f) HostraGo has a zero-tolerance policy for customers using our services to post messages or advertisements that violate the rules, regulations, or charter of any newsgroup or mailing list. However, commercial messages that are in compliance with the group’s rules or explicitly solicited by recipients are permitted.
g) Hosting publicly accessible “open relay” SMTP servers or anonymous remailers of any kind is strictly prohibited, regardless of intended use or context.
4. Bandwidth
If a customer exceeds their bandwidth allocation, HostraGo will notify the customer of the overage. Should the customer choose not to purchase additional bandwidth or upgrade their hosting plan, and the account continues to exceed the allocated bandwidth, the account will be temporarily suspended until the customer either takes corrective action or upgrades to a higher plan.
Once the issue is resolved (either through an upgrade or ensuring the limit is no longer exceeded), the account will be reactivated and will return to normal operation at the beginning of the next billing cycle.
5. VPS Rules
For optimal performance and management of your Virtual Private Server (VPS), HostraGo highly recommends using a control panel to facilitate easier operation and maintenance.
Customers with Self VPS plans will be responsible for configuring essential services themselves, such as DNS settings, user accounts, mail accounts, and any other configuration activities related to the VPS.
Please note that HostraGo’s support team is not responsible for assisting with these configurations on Self VPS plans.
6. Commercial Advertising- Email (SPAM)/UNSOLICITED COMMERCIAL EMAIL (UCE)
a) Spamming or sending unsolicited commercial emails (UCE) from HostraGo’s servers, or using email addresses hosted on our network, is STRICTLY prohibited. Any account found in violation of this policy will be immediately deactivated without refund. HostraGo will be the sole arbiter in determining what constitutes a violation of this policy.
b) To ensure optimal performance of our shared servers, cloud and VPS nodes, as well as dedicated server hardware, we have set limits on the number of outgoing emails that can be sent per hour. The limits are as follows:
- Shared & Reseller Hosting: 300 outgoing emails per hour
- VPS Hosting: 1,000 outgoing emails per hour
- Cloud Hosting: 1,500 outgoing emails per hour
- Dedicated Servers: 3,600 outgoing emails per hour (1 email per second)
c) Inbox email delivery is not guaranteed with any of our hosting plans. While we strive to maintain a high-quality service, factors beyond our control may affect email deliverability.
7. Backup Policy
a) User Content Backup – The responsibility for backing up all of your User Content lies solely with you. While HostraGo provides services to host your content, we do not guarantee the backup of any accounts or user content. You agree to assume all risks associated with the potential loss of your data, and we recommend you maintain regular backups to ensure data accessibility.
b) Liability for Data Loss – HostraGo cannot be held responsible for any loss of data under any circumstances. It is your responsibility to ensure that your content is backed up properly.
c) cPanel Backup Manager – Clients using the cPanel Backup Manager tool for their backups should download and delete their backups promptly. All backup files stored on the server will be automatically deleted every Sunday without prior notice. Hosting space is not to be used for storing backups.
8. Domain Payments
a) Domain Registrations – Once a domain name is registered, no refunds will be applicable, as the registration process is final and non-reversible.
b) Domain Infringement – You are prohibited from registering domain names that are similar to trademarked names or established brands in a way that could mislead or confuse consumers. Registering such domain names could lead to trademark infringement. HostraGo is not responsible for any legal consequences arising from such actions.
Examples of prohibited domain names include:
- flipkartsale.in
- bajajfinancecs.com
- adtyabrlafnanc.co.in
c) Domain Renewal – HostraGo will send renewal reminders for your domain one month prior to expiration. However, we are not responsible for any failure or delay in renewing your domain. Once a domain is renewed, no refunds will be issued.
9. Unlimited Hosting
a) What “Unlimited” Means: HostraGo offers Unlimited Storage, Unlimited Bandwidth, and Unlimited Website Plans. This means there are no set limits on the amount of bandwidth, websites, or storage you can use for the normal operation of a personal or small business website, as long as it complies with the terms of this Agreement. However, if your usage or content poses a risk to the stability of the server, we reserve the right to implement fees based on the additional storage usage, provided it remains compliant with these Terms.
Please note that HostraGo’s services are intended for hosting websites. We do not offer unlimited hosting for:
- Online storage (e.g., videos, images, audio, games, backups)
- Archiving of electronic files (e.g., documents, log files)
- File sharing, peer-to-peer activities, or torrenting
- Testing environments
Any use that violates this policy will result in the termination of your account with or without notice. Accounts with excessive database sizes (greater than 1 GB) can negatively affect server performance. HostraGo may request that the database size be reduced to ensure proper server performance, or may suspend the account.
b) Unlimited File Transfer: We do not impose limits on the amount of visitor traffic your website can receive or the amount of content you can upload each month, provided your use is in compliance with this Agreement. We do not charge additional fees based on bandwidth usage. In most cases, your website can handle as much traffic as you can generate. However, HostraGo reserves the right to limit processor time, bandwidth, memory, or processes if necessary to prevent disruptions to other users.
c) Unacceptable Resource Usage: The following usage is considered excessive and unacceptable:
- Running cron jobs at intervals less than 15 minutes
- Running MySQL queries that take longer than 30 seconds
- Using 25% or more of system resources for over 90 seconds at a time (e.g., CGI scripts, FTP, PHP, HTTP, etc.)
- Mailboxes exceeding 5 GB in size, or a combined mailbox size of more than 50 GB per domain
Unlimited hosting applies only to shared hosting accounts. Certain limits may apply to other types of hosting services.
10. Permitted CPU and Disk Usage
a) Shared Hosting Usage Guidelines: Disk space provided under Shared Hosting is strictly intended for hosting website-related content only. This includes web files required to run and manage your website. You are not permitted to use this space for:
- Media storage (e.g., images, audio, video not used on the website)
- Archiving files, backups, or large volumes of electronic data
- FTP hosting, demo repositories, or general file storage
HostraGo reserves the right to review and inspect all shared hosting accounts for violations involving excessive use of Storage, CPU, or any other system resource. Any account found to be in breach of this clause or our Acceptable Use Policy (AUP) may be subject to warnings, suspension, or termination.
b) Resource Limits: We may, at our sole discretion, suspend or terminate access to any Services or remove User Content that violates these Terms or affects server performance. For Dedicated Servers and VPS Hosting, resource limits and usage allowances are defined by the specific plan you purchase. Please ensure your usage remains within the allocated limits.
11. Uptime Guarantee
a) Scheduled Maintenance Exclusion: Any service interruptions or downtime resulting from scheduled maintenance conducted by HostraGo or its network providers will not be included in the calculation of the uptime guarantee.
b) Third-Party Service Failures: HostraGo shall not be held responsible for any failure or disruption in services provided by third parties, such as domain registrars, content delivery networks, or other external services integrated into our offerings.
c) Force Majeure Events: HostraGo will not be held liable for any failure or delay in meeting its obligations under this Agreement if such failure or delay is caused by circumstances beyond our reasonable control. These may include, but are not limited to:
- Actions by government agencies or regulatory bodies
- War, terrorism, insurrection, or sabotage
- Natural disasters like fires, floods, or other environmental catastrophes
- Strikes, labour disputes, or other industrial actions
- Interruptions in transportation or logistics
- Unavailability or disruptions in telecommunications or third-party services (including DNS propagation delays)
- Failures of third-party hardware or software
- Inability to obtain essential materials, supplies, or power required for service provision
12. Account Security and Company Systems
a) Responsibility for Account Security: It is your responsibility to keep your account credentials, including your password, secure. We strongly advise you to use a strong password and take precautions to prevent unauthorized access.
b) Sharing Credentials: Sharing your account access with unauthorized individuals is not recommended. You are fully responsible for any consequences resulting from others accessing or using your account.
c) Password Protection: Attempting to obtain another user’s account credentials is strictly prohibited and will lead to account termination.
d) Prevent Unauthorized Use: You must implement adequate security measures to prevent or minimize unauthorized use of your account. This includes ensuring that your account is not accessed by unauthorized individuals or parties.
e) Security Breaches: You may not attempt to bypass or undermine the security of any network, server, or system. This includes, but is not limited to:
- Accessing unauthorized data
- Logging into or using an account not expressly authorized for your use
- Probing or scanning network security. The use of tools designed for security breaches (e.g., password cracking or network probing tools) is strictly prohibited.
f) Denial of Service Attacks: You may not attempt to interfere with or disrupt service to any user, host, or network. This includes actions like flooding networks or deliberately attempting to overload a service. Users engaging in these activities may face criminal or civil liability. HostraGo will cooperate with law enforcement authorities in investigating these actions.
g) Secure Program/Scripts: It is your responsibility to ensure that any programs or scripts installed on your account are secure. Make sure directory permissions are set to 755 or as restrictive as possible to prevent unauthorized access. If your account is found to have weak security measures, you will be notified to update your settings, or your account may be suspended until corrective actions are taken.
h) System Monitoring: While we may monitor our systems to ensure authorized use and maintain security, by using HostraGo’s services, you consent to such monitoring. This may include recording, scanning, or copying information to ensure security procedures are followed.
i) Unauthorized Network Access: Any account found accessing third-party networks or systems without the necessary permissions will be subject to suspension. HostraGo may request proof of authorization for access to external networks.
j) Compromised Accounts: If your account is compromised, you are required to take immediate action to secure it. Failure to clean up your account after being notified may result in your account being disabled. HostraGo may also clean up the account for an additional fee upon request.
k) Data Center Migration: We reserve the right to migrate your account between data centers to comply with applicable laws, data center policies, or for technical reasons. This may be done without prior notice.
13. Billing Policy
a) Payment Methods: If paying via credit card, debit card, net banking, or UPI, your account will be set up immediately once the payment is confirmed.
b) 07-Day Money-Back Guarantee: The 07-day money-back guarantee applies only to first-time sign-ups. If you’ve previously had an account, canceled it, and signed up again, or if you’re opening a second account, you will not be eligible for a refund.
c) Non-Refundable Services: Refunds are not applicable for the following services:
- Domain registration/transfer/renewal
- cPanel, Plesk, Control Panel
- LiteSpeed, Softaculous, Cloud Hosting
- VPS, Dedicated Server, Paid Support
- SSL Certificates, Sitelock, SpamExperts, WHMCS
- Windows OS, SQL, G Suite, Office 365, and other paid licenses.
d) Money-Back Guarantee Eligibility: The money-back guarantee is available only on the following services:
- Shared Hosting
- WordPress Hosting
- Cloud Hosting
- DMCA Ignored Hosting
e) No Refund for Suspended/Terminated Services: No refund will be issued if your Service(s) are suspended or terminated for cause as per our terms and conditions.
f) Hosting Platform Limitations: Each hosting platform has specific limitations:
- On an OpenVZ VPS, GUI is not supported, and kernel upgrades or BIOS settings cannot be changed. No refund will be given in these cases.
- Kernel upgrades are available on KVM Cloud instances, but BIOS settings cannot be changed. Refunds are not eligible for these limitations.
g) Refund Exclusions:
- The refund will not cover the following: Taxes, setup fees, refund processing fees, postal charges, or any payment processing charges or bank fees.
- No refunds will be issued if the web hosting account was involved in: Violation of our terms of service, Illegal activities or over-usage of system resources, Requests made after the 07-day period or beyond coverage of the refund policy.
h) Free Domain Offer: A free domain is offered with the Swift and Turbo plans of Shared Hosting. One .COM or .IN domain is offered with every new purchase of a Swift/Turbo plan for 1/2/3 years.
- The domain will be free for the first year, and renewal charges will be applicable from the second year onward.
i) Adding Domain to Cart: You must add the domain name to your cart at the time of purchasing the hosting plan. The free domain cannot be claimed after the purchase.
j) Domain Charges Upon Cancellation: If the web hosting service includes a free domain name, and you decide to cancel the service:
- The domain charges (at the standard rate) will be deducted from the refund amount.
- If the refund amount is less than the domain name price, you will be required to pay the difference or forfeit the domain.
- The ownership of the domain will remain with HostraGo if you fail to pay the difference amount.
k) Domain Transfer Fees
- Transfer fees will apply if you wish to transfer the free domain name to another provider.
- The domain will not be released without the applicable transfer fees being paid.
l) Non-Refundable Payment Methods
Payments made through bank transfer. In such cases, the refund will be added as credit to your hosting account.
m) Refund Request Timeframe
Refund requests placed after 07 days from the purchase date will not be processed, and you will not be eligible for a refund.
n) Cancellation Request Procedure
Cancellation requests should be submitted through the client area to initiate the refund process.
o) Refund Processing Time
After submitting the cancellation request, it will take approximately 14 days to complete the refund process.
14. Cancellation Process
a) Cancellation Request At any point, if you wish to discontinue our services, you can submit a cancellation request through your client area. Please ensure that all pending dues (if any) are cleared before proceeding with the cancellation.
b) Immediate vs. Subscription End Cancellation
You can choose between two cancellation options:
- Immediate Cancellation: If selected, you will no longer have access to your hosting plan/service.
- End of Subscription Period Cancellation: If chosen, you will continue to have access to your purchased services until the end of your prepaid term.
c) Data Backup Responsibility
It is your responsibility to backup all data before submitting the cancellation request. Once the cancellation request is placed, all data on our servers will be deleted, and it cannot be retrieved or restored
15. Taxes
The price displayed on the site is exclusive of taxes. To view the price with taxes, please refer to the Cost Calculator of each plan. The amount inclusive of taxes will be added to your final invoice once you add items to your cart. Please note, the taxable amount is non-refundable.
16. Late Payment or Non-Payment
a) Unpaid invoices may result in the suspension or termination of your web hosting account. Your suspended account will only be restored after clearing the outstanding invoice, after which you will be able to access your data.
b) If your account is terminated, the data residing on it will not be restored and will be treated as a new account. Failure to renew your subscription on time will result in charges being added to your invoice.
c) We will not activate new orders or activate new packages for customers who have an outstanding balance on their account.
17. Invoice Disputes

18. Account Termination
Your hosting account at HostraGo can be terminated for the following reasons:
a) You decide to discontinue: At any point during your subscription, if you no longer wish to continue with our services and wish to place a cancellation request with immediate termination, your hosting account will be suspended right away and will be terminated within 48 hours.
b) Cancellation upon expiration: If you place a cancellation request to discontinue our services after your subscription expires, your hosting account will be suspended at the end of the subscription and will be terminated within 48 hours (after the expiration date).
c) You did not renew: In case you fail to renew your hosting account on the due date, your hosting account will be suspended after 24 hours and will be terminated within 48 hours (after the expiration date).
d) You violate our Terms of Service: If you violate our terms of service during your subscription period at HostraGo, it will result in immediate account suspension and termination. As soon as we are notified about the violation of service, we will take instant action.
e) Potential Fraud: We have an anti-fraud system that monitors all orders as soon as they are placed. In case of a potential fraud occurrence, we will carry out a manual verification process. If we request certain information and it is not provided, your account will be suspended and terminated immediately.
f) A Dispute or Chargeback: If a dispute or chargeback occurs during the violation of our Terms of Service, we will initially suspend your account and give you a 7-day timeframe to resolve the issue with HostraGo before termination. If the matter remains unresolved after this period, your hosting account will be terminated.
Note: It is advised to maintain a backup copy of your hosting account to avoid losing your data due to termination. All your files will be deleted from the server once your hosting account is terminated, and HostraGo shall not be liable for the same.
19. Indemnification
a) Indemnification and Liability : The customer agrees to protect, indemnify, save, and hold HostraGo harmless from any and all stipulations, liabilities, losses, expenses, and claims, including reasonable attorney’s fees assessed against HostraGo, its agents, customers, officers, employees, and administration. This includes claims arising from any service provided or performed, any product sold by its customers, agents, employees, or assigns.
b) Customer’s Responsibility for Indemnification:
The customer agrees to defend, indemnify, and hold HostraGo harmless against liabilities arising out of:
- Any injury to person or property caused by any products sold or distributed in association with HostraGo’s services.
- The loss of any electronic files furnished by the customer (or customer’s customer)
- Copyright violations and any defective products sold to a customer via HostraGo’s services.
20. Limitation of Liability
a) To the maximum extent permitted by applicable law, and without affecting your rights as a consumer, you agree that you will not under any circumstances, including negligence, hold HostraGo, its officers, directors, employees, licensors, agents, subcontractors, and/or third-party service providers liable for any direct or indirect damages of any nature and type suffered by you or third parties, including, but not limited to, damages for loss of profits, cost savings, revenue, business, data, or use, or any other pecuniary loss that may result from:
b) Delays, malfunctions, suspension, and any other interruption in the provision of the Service(s) due to events beyond our reasonable control (for example: force majeure, third-party conduct/acts, including HostraGo’s licensors and suppliers, faults and malfunctions of machines, software, and other equipment, whether owned by us or our licensors/suppliers); acts and/or omissions made by customers that contrast with the obligations undertaken under these Terms of Service (TOS); data loss due to hardware or software failure; any information, data, content in or accessed through the Services; any action, information, or instruction provided as part of our technical support services; your use of the Service(s).
c) You agree that the foregoing limitations apply whether based on warranty, contract, tort, or any other legal theory and apply even if we have been advised of the possibility of such damages. In no event, we will be liable to you in the aggregate with respect to any and all breaches, defaults, or claims of liability under these TOS or under any other agreement or document for an amount greater than the fees actually paid by you to us for the respective Service(s) during the twelve-month period preceding a claim giving rise to such liability. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. You agree that in those jurisdictions, our liability will be limited to the extent permitted by law and your rights as a consumer will not be affected.
21. Dispute Resolution. Jurisdiction
a) In the event of any dispute, controversy, or claim arising out of or related to this Agreement, you and HostraGo shall use reasonable effort to settle such disputes or differences. To this effect, we shall consult and negotiate with each other with the aim to reach a solution satisfactory to each Party.
b) You agree that the Courts of Rajkot, Gujarat (India) shall have the sole jurisdiction over all disputes and other matters relating to the execution, interpretation, enforcement, and termination of this Agreement or any other document entered into by the Parties related thereto. All disputes and other matters relating to the interpretation and enforcement of these TOS, as well as any other document entered into by the Parties, shall be governed by the laws of India.
22. Certain Services; 404 Error Page
If you haven’t configured a 404 page, our default page for the 404 error will load when a visitor tries to access a URL that has no information. By not creating a 404 page, you hereby agree and authorize the Company’s placement of a default 404 error page. This 404 error page may contain advertisements and other information about the Company and its services. As a company, we reserve the right to withhold and collect all revenue generated from these advertisements.
23. Price Change
We reserve the right, to modify the prices, or yearly payment amount, or any other amount at any given time. It’s your responsibility to review billing information from time to time.
24. Change of TOS
HostraGo may modify these TOS at any time with immediate effect. Where the change in Terms is required by law or related to the addition of a new service, extra functionality to the existing Service(s), or any other change which neither reduces your rights nor increases your responsibilities, the TOS will be changed without prior notice to you and shall have immediate effect.
No clarification or explanation of the Terms provided by the Parties will have the power to modify the provisions of these TOS.
